CICA legislative changes and underwriting updates

The 1st September 2021 will see key changes implemented under the Consumer Insurance Contracts Act 2019 (CICA).

What changes will CICA bring?

Pre-contractual change

The introduction of a statutory duty to answer all questions posed by the insurer ‘honestly and with reasonable care.’ This replaces the (up to now) contractual duty of ‘utmost good faith’, a significantly lower standard.

Claims stage

Proportionate remedies for misrepresentation by the customer, depending on whether the misrepresentation was innocent, negligent or fraudulent. Regulation sets out the action that needs to be taken under each of the three categories. 

Changes at new business stage

We will be amending the medical questions we ask for underwriting purposes as a result of these changes. Our online submission system, ePos, will be updated with effect from close of business on the 27th August. From this date, existing protection application forms will no longer be valid. In addition to application forms, protection booklets, product terms and conditions, and supplementary forms will be updated to comply with CICA.
